Wife Laid Off, Found New Job, Took Leave To Have Kid 2 Months Later, Can You Pay Ins. Prems For Leave From Hsa?

Postby Ardel » Tue May 30, 2017 3:37 pm

My wife was pregnant when she was part of a reduction in force.
She found a new job very quickly and thus was never on unemployment.
As part of her new job, she had new insurance.
Since she hadn't been there long enough, she took a voluntary leave after having our son.
Now we owe for her insurance premiums while she was on leave.
Is there any way I can pay these out of my HSA? Her employer won't take them out of her check.
I just want to try and pay them pre-tax.

If you pay the premiums from your HSA you'll be subject to taxes and hefty penalties.
So, you CAN technically do it, but you wouldn't want to...it's quite the opposite affect you're trying to achieve.

An HSA can be used for (1) COBRA insurance, (2) insurance while receiving unemployment, and (3) long-term care insurance.
It cannot be used to pay for regular health insurance pre-tax, unless receiving unemployment.
