What Will The Crime Be Or Violation Of Law When The Government Health Plan?

violates an individual's rights or limits their ability to seek medical attention of their choice when such action results in disability or death?

What timely recourse of grievances will an individual have that cannot afford a private attorney or the State's attorney works with the State to maintain stats that are favorable for future Federal grants or funding?

If we're required to purchase health insurance from private companies, then any issues we have with that particular company would operate between the patient and that company with the exclusion of the government's involvement.

A person can always sue, but here's the problem: any time the little guy stands up to the big guy (a large corporation, insurance conglomerate, etc.), they risk personal bankruptcy due to court costs & attorneys' fees while in the process of suing.
The odds are that they might very well lose & don't collect any financial restitution--then where will they be? Most people cannot afford that risk, and large companies know that.
That is part of the reason why they are seldom held responsible for wrong-doing or negligence.


Another reason they are 'untouchable' is that politicians are subsidized by these special interest groups, therefore, the legal language written for their policies is loosely written.
There is verbiage such as, "Such & such company "MAY" be responsible for..." rather than "Such & such company IS responsible for..."

So to answer your question, there is no "timely recourse".
When referring to future grants, are you referring to the State's funding of particular health care companies? If so, I don't know how that is decided upon other than the example of how many state and city-run hospitals' fundings have been cut due to the recession.
But my personal bias leans toward that government funding is being cut in lieu of supporting two wars and corporate bailouts.
Therefore, the social service financial pool is being rationed to keep other social programs afloat, such as unemployment insurance (which is of primary importance these days).

I have recently looked through both the House and Senate bills, and don't recall seeing a provision for private action in either.
I may have missed it (gawd, I hate contrived legalese) and will look again, but normally federal acts disallow individuals from pursuing private action in most cases.

Heck, they won't cover themselves with this plan; why would we think there would be any assumption of responsibility for negative consequences? We really need to get rid of most of those Talking Monkeys in DC next November and see if we can get some people with brains in there.

At the moment (un)insurance companies are letting that happen so no, it will not be a crime.

FACT - Insurance companies in the USA admit to pushing up prices, buying politicians and not paying out claims when they should [1]

FACT - PER PERSON the USA spends more on healthcare than any other nation on the planet [2]

FACT - Obama debated his plans before the election for healthcare [3]

FACT - the chance of a child under five of dying in the USA is greater than industrialised nations with universal health coverage [4]

FACT - Obama was elected by the American people to bring in change [5]

FACT - Obama wants to stop insurance companies from screwing American [6]

FACT - The reforms Obama wants work in the Netherlands and Switzerland [7]

Let me know if my facts are wrong, but please provide proof.

From what paranoid information source did you get this? there is not any enemies checklist. you're thinking of George W. Bush, who indulged in warrantless wiretaps and searches and who, with Dick Cheney, created the "in case you do no longer trust us, you're a traitor" mentality we are nonetheless attempting to recover from. of course, you haven't any longer gotten over it and might't comprehend that the present administration would not function this manner. Not sure. That problem doesn't exist right now because it's illegal to sue HMOs regardless of their negligence or breach of contract.

If the government were to cause death or disability through negligence or breach of contract, at least they would be liable.
