If someone for whatever reason did not want to have insurance, would they still have that option?
asking for a debate project. If someone could provide a source, that'd be pretty cool.

Here is the kicker. Everyone ALREADY HAS limited health insurance. If someone goes to a hospital or emergency room and they are critically ill, the hospital is required to provide care. But not everyone is PAYING for this priveledge. As a result, those who DO pay for health insurance are making up the difference from those who DON'T.

If you don't want Obamacare, or something to replace it, then get rid of the law that says the ER is required to provide treatment to someone who is dying. (Good luck getting that law passed, but the way.)

Now you know why unemployment is so high. No one really knows the answer to your question. Hence businesses are not hiring until it is resolved.

@diana .. you actually do not have to pay anything. It is a unenforceable penalty.

what is the penalty for not paying that new tax? Well, on page 170 of the actual law, we read:

(A) WAIVER OF CRIMINAL PENALTIES.-In the case of any failure by a taxpayer to timely pay any penalty imposed by this section, such taxpayer shall not be subject to any criminal prosecution or penalty with respect to such failure.
(B) LIMITATIONS ON LIENS AND LEVIES.-The Secretary shall not-(i) file notice of lien with respect to any property of a taxpayer by reason of any failure to pay the penalty imposed by this section, or(ii) levy on any such property with respect to such failure.

Is ObamaCare great or what? With all the taxes I'm familiar with, if you don't pay them, you're in big trouble. But with ObamaCare, there's no enforcement -- it's a toothless tax. And the lack of enforceability was known about before the bill was signed. In 2010, Fox News reported:

No one is forced to buy it. However, if you can afford health insurance but choose not to get health insurance, you will be asked to pay a fine. I say "asked" because there is absolutely no enforcement method for this. As in, theres no penalty if you don't pay.

The payment though, is to cover the cost of Emergency Room treatments, but again, only for people who could afford insurance but did not get it. Its because right now, if people dont pay for their ER trips, the cost is shifted to us.

You either buy insurance or face Federal fines enforced by the IRS. You know what happens when you incur Federal fines? Federal criminal charges. So, it makes no difference what you can afford because you're going to get it either way. What genius honestly thinks people wouldn't have health insurance if they could afford it? Forcing people to buy what they can't afford doesn't really make it morally sound.

It's a horrible eventuality that's ripe for abuses in many areas.

This is a simple answer and reflects on the only people who can say they were taxed.
If you do not have Health Insurance there is going to be a IRS penalty.
Which is the "tax" that the supreme Court said Congress had the right to levy.
In Massachusetts you lose your personal deduction, which Federally is $10,080.00 or $1400.

Despite the GOP rhetoric, only the un insured are penalized.

yes they would have to have ins or pay a fine.EDIT: yes you WILL have to pay a fine if you do not have ins...They can and will take it out of your tax return.This was on the news just a few days ago.It will all be taken care of by the IRS.

You are not mandated to have health care it is up to you. Source the Affordable Care Act.
