Rights as the owner of my ex-husbands life insurance policy?

Rights as the owner of my ex-husbands life insurance policy?

Postby darius » Wed Apr 04, 2012 7:59 pm

My ex-husband failed to bring up in the divorce a life insurance policy of which I am the owner. Our children are the beneficiaries but I am listed as the owner. What are my rights as the owner of this policy? Does it matter that the policy was originally purchased before we married? Can he force me to sign it over to his mother as he keeps demanding?

Rights as the owner of my ex-husbands life insurance policy?

The divorce judge should know the probate laws in your state prior to making his or her decision during the divorce case. It doesn't make sense that you are the owner of the policy that he took out on his life? You mean it's a whole life policy on his life with you as the beneficiary? If he took out the policy and is making the premium payments, then he can change the beneficiaries (following the divorce closing) to whomever he wants. Any reasonable ex would still keep the kids as the beneficiaries through a trust but he is allowed by law to change it to whomever he wants once the divorce is final.

Who's making the premium payments? If the divorce is final , then he doesn't need your permission to change the beneficiaries.

As the sole owner of the policy, you get to decide who the beneficiary is. You also have to pay the premiums for it.

If it wasn't part of the asset division of the divorce, it's still yours. Or, he can bring you back to court over it.

No, he cannot force you to sign it over to his mother.
