My husband and I are separated and I cannot afford the health insurance. He is presently on my plan. Can I remove him?

Of course you can. Speak with you HR dept...they can remove him any time you want.

The others are wrong. You can remove people anytime you want, you don't have to wait for enrollment. However, if you want to add anyone, you do have to wait for open enrollment.

the status of your relationship, Single, married, divorced, has no bearing on whether you can remove him or add him.

If you leave your job and get a new one, you do NOT have to add him to your insurance. You can add or not add whoever you want.

I think it would be considerate if you asked him to pay the difference. I wouldn't remove him without discussing it with him and with your attorney. Way too many people are walking around with no insurance. Even if you're mad as heck.. try to be a good guy on this one.

In order to make a change to your insurance outside of the annual open enrollment period, you have to have what is considered a "qualifying life event". Depending on your employer, a legal separation may very well be considered a qualifying event to allow you to remove him from the insurance. Some employers consider legal separation to be a qualifying event, some will make you wait until divorce, but you have to find out through the HR department.

YOu can always remove someone from your health insurance at any time but adding them back to your health insurance is only done during your companies open enrollement period which varies from company to company. Adding someone back to your health insurance at any other time other open enrollment can be done if its a qualifying event e.g. loss of previous coverage, marriage, birth or adoption. You can add any family member to your health insurance, husband, 1 kid or all, just your husband or just your kid/s it is not a law to add everyone, even yourself can deny it if you dont want it unless your job pays for it 100%. Insurance Agent in CA.
