What is the maximum days permittted for Maternity Leave with pay? Does that depend on company policy if its a private limited company?

Dear Nitya,

The maximum period for which any woman can be entitled to maternity benefit is twelve weeks.

The amount payable is worked out on the basis of the average daily wage and is calculated on the basis of the amount payable to her for the days on which she has worked during the period of three calendar months immediately preceding the date from which she has absented herself on account of maternity.

It applies to any organzation where there are 20 or more employees including woman exception to the it is the Act does not apply to any such factory/other establishment to which the provisions of the Employees' State Insurance Act are applicable for the time being. The private limited company in my opinion is governed by the Maternity Benefit Act, 1961.
