I Just Changed Jobs. Do I Have Short Term Disability When I Give Birth?

Postby Inocencio » Tue Oct 10, 2017 6:20 am

I am on COBRA insurance though my parents as I have been in bettween jobs for a while now.
I am pregnant and just got another job, but I will not be going on their insurance plan until after the baby is born.
Will I get paid while on maternity leave.
Who would pay, my new job or my COBRA insurance.
Am I eligible for assistance through the state? Im very confused.

I believe you should still be covered by disability but your employeer doesn't necessarily HAVE to hold your job for you. I was only employeed for a few months before I went on leave with my first child and that's what I was told by HR/Payroll. They of course DID hold the job for but since I hadn't been an employee for more than a year it wasn't legally required.

Depends on your state.

I'm in New Jersey and this is our website http://lwd.dol.state.nj.us/labor/tdi/tdi...

In order to have a valid claim for disability, you must have had at least 20 calendar weeks in covered New Jersey employment in which you earned $143 or more (called "base weeks"), or have earned $7,200 or more in such employment during the "Base Year" period.

The "Base Year" is the 52 weeks immediately before the week in which your disability began. Only covered wages earned during the base year period can be used in determining your claim.

We're covered under temporary disability but you have to work so many weeks before we're covered... I'm not sure how your state is though! I just wanted to give you an idea based on NJ

COBRA has nothing to do with maternity leave, other than it covers your health insurance.

I don't think your new job is required to pay your leave by law.
You haven't been there long enough.

I don't have an answer to that but try calling your insurance company first and explaining the situation if that doesn't give you the answer your looking for then go to you HR manager at work and ask what needs to be done...they can not tell you your not eligible for maternity leave.
