She was backing out of a parking spot in front of the restaurant. Did everything she was supposed to do but didn't see the guy till he was right behind her but it was two late. Now there is harly any noticeable damage on his truck, but my back bumper will need to be replaced. The problem of the situation is that for him to be behind her going the direction he was, he would have been making a left turn. The only way into that parking lot is from a one way street which he drove the wrong way on because it was "more convienient" than driving all the way around... The cops said that the fact he went the wrong was didn't matter though...... So what do we do? If he had followed the do not enter sign this never would have happened. :(

you have to talk to your insurance company.

Since the other driver was doing something illegal, your insurance company might choose to sue his insurance company.

The last people to ask about the law are cops.

Of course it matters that he was going the wrong way in a one way street. Although the blurb will say that your girlfriend was wrong as she should have checked in all directions, she is entitled not to expect someone going the wrong way in a one way street.

State what happened clearly on your insurance claim. If he ignored traffic signs the accident is his fault.

Everybody seems to be missing the point that the accident occurred in a parking lot, not on the street, therefore he wasn't doing anything illegal. Since he was in the driveway he had right of way and since your girlfriend was backing out of the parking space she is at fault. How he came to be there is irrelevant. Your insurance company will investigate and assess responsibility and if they find that his actions contributed to the collision in any way they will assess damages proportionately. As for your insurance you will have to check with your company to check if she is covered or read your policy. Some companies cover other drivers but this is usually an addendum to the basic policy.

If I understand this situation - the police said that the other guy operating a motor vehicle in an illegal manner didn't matter?

So they admitted to knowing the Motor Vehicle Law had been violated and chose not to cite that person. Hmmm - be sure to mention that fact to your ins.co. and the adjuster.

According to NY law, anyone operating a vehicle in any direction but straight ahead, is considered to be at "fault" in the event of any accident.

Since she was operating the car, then she is "at fault" for the accident. The insurance YOU buy "covers" YOUR car and its occupants. Therefore, her personal car insurance (if any) is inconsequential. Also any claim you make will be listed on your automobile insurance "record", so you might want to pay for this incident yourselves. Since the other driver hasn't filed a claim against you, and if you were to have a more serious collision within the next eighteen months, any company reviewing that "record" would see two claims filed within less than two years, and consider YOU (not her since it's your insurance policy) a "risk" and rise your rates accordingly.

To sum it all up - any collision involving a vehicle that was reversing, the reversing vehicle is viewed as not Yielding Right of Way to the collided with vehicle, and is therefore "at fault" for the accident. Which is exactly why I got paid $1250. for the repair of the right front fender of my car when the other person backed out of a parking space into it.

Perhaps in the future, you'll both consider backing into the parking spot so that you'll have clear view of someone driving in an illegal manner, thereby avoiding a collision.

You'll have to ask your insurance company.
She is likely not covered.

You have 2 issues with your insurance company, coverage and fault.


Your GF would most likely have your permission to drive your car, but if she is living with you and not listed on your policy, they can deny, since you failed to list her.
But if not living with you and is not driving your car on a regular basis, but "occasionally", then your policy will cover this accident.


Parking lots are accidents waiting to happen, as we say in the insurance field.
In most cases, after the adjuster takes your GF statement and the other guys statement, they will usually find that both parties are at fault, but your GF, since backing up, will be held majority of fault.
People think that because they are driving down an aisle, they have no fault, but,,,,in a parking lot, you have to expect that people pull in/out all the time, so have to be alert for this.


What you do, is file a claim on your insurance and the adjuster will make the call, since that is there job,,,,,,,period.
