Fired for failing to meet sales goals, will I get unemployment insurance in MD?

Postby adalric » Sun Jun 09, 2013 9:32 am

For the past year, I fell under my sales goals for my company. I was let go for "performance" because I was unable to make sales goals. Period. I was not fired for being late, etc. Performance only. To my understanding that is not misconduct. Will I be able to collect UI.

It kind of depends on various factors. Were you doing great and suddenly plummeted for no explainable reason? Is everyone else meeting standards except you? Or did the market take a bad turn that really hurt everyone? Or do they keep raising the performance standards? Obviously, if someone goes on an intentional slow down strike and gets fired, they do not get unemployment. But if you were justifiably unable to meet the goals, then you will possibly qualify. Be ready to explain in detail how this came to be....

No, because while it is not direct misconduct, it is firing for cause, not a lay off outside the control of the employee.

uh...failure to perform your job at an expected level is splitting hairs.

"To collect Maryland unemployment, you must be unemployed through no fault of your own."

uh...kind of your fault here.....

Apply; don't expect to win.
