If you object to health insurance as a matter of conscience, you can opt out.

Such a clause is already in effect for Medicare, and generally applies to groups such as Christian Scientists who do not believe in medicine.

BTW, if Medicare is Constitutional, how can Obamacare not be Constitutional?

Yes, I did. It is a religious exemption. It is added with Christian Scientists in mind.

(B) will provide coverage and cost sharing protections against excessive out-of-pocket spending that are at least as affordable as the provisions of this title would provide;

(C) will provide coverage to at least a comparable number of its residents as the provisions of this title would provide; and

(D) will not increase the Federal deficit.

It’s called the “Empowering States to be Innovative” amendment. And it would, quite literally, give states the right to set up their own health care system — with or without an individual mandate or, for that matter, with or without a public option — provided that, as Wyden puts it, “they can meet the coverage requirements of the bill.”

Note: For reference see the Senate Bill pages 103 and 212.

(A) will provide coverage that is at least as comprehensive as the coverage defined in section 1302(b) and offered through Exchanges established under this title as certified by Office of the Actuary of the Centers for Medicare & Medicaid Services based on sufficient data from the State and from comparable States about their experience with programs created by this Act and the provisions of this Act that would be waived;

*The "if you don't drive a car, you cannot be forced to buy car insurance argument fails for those against the mandate" because you cannot choose not to be sick. If you do, and without the insurance, guess who's going to pay your bill?

you must have missed that mass infusion by congress and the president to opt in to this wonderful plan. the admin. claimed all along that obamacare was not a tax therefore, they can not mandate a citizen must purchase a product. if you don't own a car or drive you don't have to purchase auto insurance. there are different rules for states vs. federal govt.

Sanity is completely full of crap and I'm wondering how much he or she gets paid to toe Obama's line. Without the mandate Obamacare cannot be funded and will explode the federal budget. Maybe he (because no woman is going to come up with a crappy argument like his) ought to read the Constitution. There is nothing in the Constitution that gives the federal government the power to force anyone to engage in commerce. NOTHING.

Yes, you are correct about the health insurance mandate portion of the Health Care Act (if you support it dont demean it with that other name). There will be a hardship and a religious exemption. I think it is a good deal getting your own policy tailored to your needs and getting a tax credit back.

Like auto insurance Medicare is actually managed by the states which does have that right, but eh federal government does not. THe money you pay goes through the states and up to the federal government is how they got around it.

The Obama Administration has tried to put the mandate, after seeing that the Commerce clause would not work, as a TAX.

It is Constitutional on the grounds of Commerce Clause, just like mandatory Auto Insurance.
