Hi there i was in a pretty bad car crash yesterday. The car aquaplaned side ways and the car rolled and landed in a hedge, luckily we are all fine so it seems but my neck is starting to ache quite a bit as of my friends who were in the accident, the driver was only 17 and it wasn't his fault as you probably think he wasn't going fast, it wasn't like that. If i was to have whiplash and make a claim i would give the money to my friend who was driving to help getting him back on the road (we all feel guilty as sin) but would that affect his car insurance (full comp) for next year? Hes not claiming on his car insurance as its not worth it. Also my friend has health or life insurance or something if he claimed though that would that affect my friend insurance for next year also or does that work differently ? Thanks for your help im in the UK. Ta

These days insurance companies are getting more and more strict about whiplash claims. They often send in a doctor to interview you and make sure that the injury is real.

Not to mention, it's highly unethical as well.

Since you are in the UK, report it and sue for a million dollars. You can buy a new flat, and watch the telly while drinking tea and eating crumpets!

Um, if a car hydroplanes, it IS the fault of the driver.
It doesn't matter whether you are in the UK, Canada, Germany, wherever, by law the driver is supposed to maintain control, and an accident caused by hydro-planing is an at-fault accident, whether the police issue a ticket or not.
If the car rolled, it is likely a fairly expensive repair, he needs to claim on his insurance, that is what it is for.
Claims for whiplash aren't always easy to make. If he has full comprehensive AND collision and upset, he will only be out his deductible (excess?).
He will need to file a report with his insurance, or your claim for whiplash will generate an investigation anyway.

dude, yeah t would, kinda sounds like you are a mercenary, out to make a gain by any means needed. even hurting other people.this boy sounds like he is an exception to the typical teen driver adn you want to hurt him for that. go die punk

If your friend was not at fault for the accident - then you have no basis to make a claim against his insurance policy. The whole basis of getting paid by his insurance is negligence. Because of your friends negligence, you were injured and are asserting a claim against his policy.

If you feel guilty as sin about your friend wrecking...then there is something big you have left out of this story. It's not as clear cut as you present it.

Yes, your friends car insurance rates will go up if you make a claim against his policy.

You can't have it both ways....your friend not at fault but you get money. Either he's at fault and you were injured and need to make a claim against his policy or he was not at fault and you pay for your own medical treatment.
