so my sister got into a car accident and totaled her car, it was 100% his fault, and he had an expired license and we thought he had insurance at the time, but we found out today that he didnt.. Now everything has to go through our insurance, our rates are being raised, and nothing is happening to this guy? also were only getting 4000 dollars for our car.. this doesnt seem right, what do we do? just sit and accept it?

Yes, she'll just have to sit and accept it. As unfair as it seems, life is like that sometimes. She should be grateful that she has the coverage on her policy to take care of her. That's what she bought it for.

Her insurance will go after the other party to recover their losses (and get your sister's deductible back).

If her car was only worth $400, then she got all she's entitled to.

Were the police involved? The other driver should have been arrested for driving w/o a valid license and driving w/o insurance.
That's the thing that stinks about accidents with uninsured drivers--your insurance company takes the hit.
You or your insurance company might be able to sue for damages, but considering court costs and the fact that the other driver probably has no assets, a lawsuit might be a waste.

Then jack this guy up using the legal system, take him into small claims court for all the money he owes you for damages, then go back to court and get a what amounts to a lien on his pay check everymonth, the court can order this and he has no choice. So you need to figure out how much he owes and then send a letter of demand to him asking for all of the cost of the car. if the car was worth six grand ask for six grand and plan to give 4 thousand back the the insurance. And while you are waiting for all that to go through, be sure and send a short letter to the dmv that he was driving with no license and he had no insurance and he has not paid for the damages. So if he tries to get his license back there will be a record that he did not pay tor the damages and the court can make him paying damages back as part of the deal. If the car was owned by somebody else, besides him then find out and sue them too , because the owner of the car is supposed to have insurance.
sometimes you have to do what you have to do to put a bee up that A holes butt.
keep in mind, that will frost him more than him totaling your car, you guys chasing him around finding out where he works and stuff, good luck make that U P S MAN ( USLESS PIECE OF S HIT) PAY
