Can You Quit Your Job And Still Get Unemployment Insurance?

I live in california and my employer wants me to quit my job and get paid $3000. If not I get fired with cause. This is due to some inssues we have with the state and my employer has given three of us these options. Now if we get fired with a cause, can we still qualify for unemployment? Or if we quit and take the $3000, can we still qualify for unemployment?

NOPE

If fired for cause you would be denied Unemployment and have to appeal

If you Quit and receive severance pay, you can't collect immediately, and may not be eligible at all because you quit

You could apply and if denied, appeal, that you quit by agreement of employer with payment of $3K severance

If you quit and take the $3000, no.

If you're fired for cause, probably not, but depends on what the cause was.

Not enough information to say.
The underlying reasons will determine if you are eligible for benefits or not.
If the state determines that the reason for your quitting was that you were forced out for a reason that would not constitute good cause, you would be eligible for benefits whether you took the severance or not.


The fact that your employer is offering a cash settlement would indicate that their case may be rather weak, or it could be that they decided that paying $3,000 would be cheaper than fighting a case with EDD.

You might wish to consult with a local attorney before you make any decisions.
EDD might be able to help as well.
There is no cut and dried answer in your case, especially in California.

learn the laws there b4 u get burned.

3000 will not last long what a month or 2?

any time you quit you are not entitled to unemployment

I know, I quit twice and neither time did I collect unemployment even tho the last time I felt I had good reason to quit
