Can You Get Paid Medical Leave For Breast Cancer?

Postby odhert48 » Tue Sep 05, 2017 4:40 am

One of my family members was recently diagnosed with breast cancer. She's been working at a fast food chain (Subway) for the past 10 years or so... With her recently diagnosed illness, she will need to stay home and rest; especially since she will be starting chemotherapy and getting surgery soon.

We are a low income family and her having to stay home would affect our financial situation drastically. Of course, we'd risk all of that for the sake of her health, but it would be very helpful if we had some financial assistance while she gets treatment and recovers. Can she get a paid sick leave? If so, how should we go about applying for it?

If she has medical leave at work ? yes. There is not anything to apply for, but most employers require a doctor?s note if they are off work more than a day or two.

Some employers offer disability policies and if she has one she needs to speak to HR about it.

She can apply for disability if necessary. Her doctor can help with that. Most people work though breast cancer treatment and take off time here and there.

If she quits her job she can apply for unemployment.

I don't know the disability laws where you are but don't just assume that she won't be able to work.
I had stage IIB breast cancer and had four months of chemotherapy (once every three weeks for six cycles) followed by six weeks of radiotherapy.
I managed to work for most of the radiotherapy and had about 7-10 days off for each infusion.

Best of luck to her.

if her work offers short term or longer term disability, she will get it.

if it doesn't, she can go on sick leave through unemployment.

just contact an unemployment office, and they will explain what she needs to do.

i wish her and the family the best.

Most employees pay into a State Disability Insurance program.
If you are temporarily or permanently disabled, you can have this program pay a portion of your salary.
There will be a requirement for a doctor to sign that your mom is unable to work, and there is usually a waiting period of a few weeks between the application and payments.
She needs to contact the Subway Chain human resources department to start the paperwork, and she needs to have her doctor define at what point she will not be able to work, and when she will be able to go back.

Start the process as soon as you can, to deal with the waiting period.

If Subway offers sick leave, she may be able to be paid for time she missed by this policy.
This comes directly from the company and your mom may or may not have any to use.
Same with vacation pay.
