Can I Go To Small Claims Court To Recover Out Of Pocket Expenses From A Wreck?

The insured only has a $5,000 limit for property damage in California. There were (5) cars involved so his insurance had to pro rate what they would pay. I am being offered $98 and my out of pocket expenses are $1,100. Can I sue for this amount? Thank you.

Yes you can but think again and ask yourself what does the court give you but a "judgment".

A judgment is worth only what can be "attached"....
That means you would have to locate a bank account or an employer and then execute to attach the asset.
