Where would you take money from? If you are speaking of her bank account, you would have to be on it as a signatory or you would have to be the payee upon death to get any of it. Her social security ends too and that money cannot be used. The bank account has to be claimed by her next of kin.

Before my brother and I could obtain the funds from my mother's checking account when she died, which I filed for through the probate court, I had to produce the paid receipt from the funeral home. If you do not have a paid receipt from the funeral home, the funds would more than likely go straight to the funeral home, rather than to you.
